Hivepod Terms of Service

1. Parties

These Terms of Service ("Terms") form an agreement between you and Shenzhen Resopod Technology Limited Company ("we", "us"). They govern your use of Hivepod (the "App" or "Service"), including its iOS mobile client, desktop client, and optional Relay service.

By downloading, installing, or using the App, you agree to be bound by these Terms. If you do not agree, stop using the App immediately.

2. About the Service

  1. Hivepod is a desktop graphical front-end for command-line AI agents such as Claude Code, Kimi, and Codex. The App itself does not perform AI model inference, code execution, or tool invocation — these are carried out by the underlying AI agents via their own official APIs.
  2. The iOS mobile client is a remote client for the desktop app and requires pairing with a desktop instance for full functionality.
  3. The Service is provided free of charge, with no in-app purchases, subscriptions, or paid tiers. Any API usage fees you incur with third-party AI providers (Anthropic, Moonshot, OpenAI, etc.) are your responsibility and are paid directly to those providers.

3. Accounts and Activation Codes

  1. The Service does not require a traditional account (no username, password, or phone number) and does not collect your real-name identity.
  2. To gate access to our optional Relay service, we use activation codes (invite codes). Activation codes are bound to device identifiers and are not linked to your personal identity.
  3. You are responsible for safeguarding your activation code. You bear any consequences from its disclosure or misuse caused by you.

4. Acceptable Use

You agree not to use the Service to:

  1. Violate the laws of the People's Republic of China or any other jurisdiction in which you reside.
  2. Endanger national security, incite ethnic hatred, or undermine social stability.
  3. Cause the underlying AI agent to generate or disseminate violent, sexual, gambling, drug-related, terrorism-related, or otherwise unlawful content.
  4. Conduct cyber-attacks, denial-of-service attacks, exploit vulnerabilities, or attempt unauthorized access.
  5. Infringe any third party's intellectual property, image, reputation, privacy, or other lawful rights.
  6. Decompile, reverse engineer, redistribute without authorization, or circumvent the App's security mechanisms.
  7. Abuse free quotas or run mass automation that maliciously exhausts Relay resources.
  8. Carry out activities that violate the Interim Measures for the Management of Generative AI Services or other applicable AI compliance regulations.

We may revoke activation codes and restrict or terminate Relay access for devices that violate these rules, and reserve the right to pursue legal remedies.

5. Intellectual Property

  1. All intellectual property rights in the App itself, including copyright, trademarks, and patents, belong to us and our licensors, and are protected by applicable copyright law and international treaties.
  2. The prompts you enter, the personas you configure, and the skills you create remain yours.
  3. Ownership and liability for content generated by the underlying AI agents ("AI-generated content") are governed by the relevant AI provider's terms and applicable AI regulations (e.g., the requirement to label AI-generated content where required, and prohibitions on illegal use).
  4. You may download, store locally, and use your conversation content for your own purposes without further permission from us.

6. Third-Party Services

  1. The App integrates with multiple third-party AI providers (including but not limited to Anthropic / Claude Code, Moonshot / Kimi, OpenAI / Codex, Alibaba / Qwen / Qoder, Tencent / CodeBuddy, and OpenCode-supported providers). Those services are provided by their respective providers and governed by their own terms and privacy policies.
  2. You must obtain and safeguard your own API credentials with the relevant AI provider, and you are responsible for any usage fees.
  3. You may choose third-party network services (Tailscale, ngrok, etc.) to carry the phone-to-desktop connection; the terms of those services are between you and the relevant provider.
  4. We are not responsible for the availability, accuracy, or security of any third-party service.

7. Changes and Suspension

  1. We may update, change, or discontinue parts of the App as required by our business. Material changes will be announced in-app, on our website, or via the feedback email.
  2. We may suspend the Service for maintenance, upgrades, or force majeure, and will make reasonable efforts to provide advance notice.
  3. We may unilaterally suspend or terminate the Service to you if you breach these Terms or applicable law.

8. Disclaimer

  1. The App is provided "as is". We make no express or implied warranty as to the accuracy, completeness, legality, or fitness of any output from the underlying AI agents. AI-generated content is for reference only and does not constitute professional advice (consult a licensed professional for medical, legal, financial, or investment matters).
  2. You bear the consequences of any action or inaction you take in reliance on AI-generated content.
  3. We are not responsible for losses caused by a third-party AI provider's service interruption, pricing change, or data handling.
  4. We are not liable for unavailability due to network outages, force majeure, third-party fault, or other causes outside our direct control.

9. Limitation of Liability

To the maximum extent permitted by applicable law, we are not liable for any indirect, consequential, special, or punitive damages, including loss of profits, loss of data, or loss of goodwill arising from your use of or inability to use the Service. Our aggregate liability under these Terms shall not exceed the amount you paid for the Service in the preceding twelve months — given the Service is free, this cap is USD 0.

This Section does not exclude liability that cannot be excluded under applicable law (such as death or personal injury caused by intent or gross negligence).

10. Minors

The App is not directed to children under 13. Minors aged 13 to 18 should use the App under the supervision of a parent or guardian, who assumes the corresponding duty of care.

11. Governing Law and Disputes

  1. These Terms are governed by, and shall be construed in accordance with, the laws of the People's Republic of China (Mainland), excluding the laws of Hong Kong, Macao, and Taiwan.
  2. Any dispute shall be settled through friendly negotiation; failing that, it shall be submitted to the competent People's Court at the domicile of Shenzhen Resopod Technology Limited Company.
  3. Users outside Mainland China: if you reside outside Mainland China, these Terms apply to the extent not in conflict with mandatory consumer protection laws of your jurisdiction; any conflicting provision yields to local law.

12. Changes to These Terms

We may revise these Terms from time to time. Material revisions will be announced in-app, on our website, or via the feedback email. Continued use of the App after the revision constitutes acceptance; if you do not agree, stop using the App.

13. Miscellaneous

  1. If any provision of these Terms is held invalid or unenforceable, the remaining provisions remain in effect.
  2. Our failure or delay to exercise any right under these Terms does not constitute a waiver.
  3. These Terms constitute the entire agreement between you and us regarding the Service.
